The Family and Medical Leave Act (FMLA) allows eligible employees to take up to 12 work-weeks of unpaid leave each year for family or medical reasons. Employees must meet eligibility requirements before they are entitled to leave. To be eligible, an employee must:

  • Work for a covered employer
  • Have worked for the employer for at least 12 months
  • Have worked at least 1250 hours over the past 12 months
  • Work at a location where at least 50 employees are located within 75 miles

The RFI has been published in the Federal Register with a 60-day comment period. The Department encourages interested parties to submit comments on the RFI by September 15, 2020.
