Equal Pay Law

Effective July 1, 2022, an employer may not pay any full-time employee a wage less than it pays an employee of the opposite sex in the same establishment for equal work on a job requiring equal skill, education, effort and responsibility, and performed under similar working conditions.
 
Exceptions apply to pay differentials based on:
 
  • A seniority system;
  • A merit system;
  • A system that measures earnings by quantity or quality of production; or
  • Any other factor other than sex.

The law contains a private right of action and protections against retaliation. Lawsuits must be brought within two years from the day the employee knew or should have known of an employer's alleged violation.

Medical Cannabis Legalized

This month, the Mississippi Medical Cannabis Act (the Act) legalized the medical use of cannabis by a qualifying patient with a debilitating medical condition. However, the Act does not (not an exhaustive list):

 

  • Require an employer to permit, accommodate or allow the use of medical cannabis, or to modify job or working conditions of an employee who engages in the medical use of medical cannabis or for any reason seeks to engage in its use;

  • Prohibit an employer from refusing to hire or from discharging, disciplining or otherwise taking an adverse employment action against an individual as a result, in whole or in part, of that individual's medical use of medical cannabis, regardless of the individual's impairment or lack of impairment resulting from the medical use; or

  • Prohibit or limit the ability of an employer from establishing or enforcing a drug-testing policy.

Also, the Act does not allow the smoking of medical cannabis in a public place or in a motor vehicle. This includes vaping and any other method of inhalation of the drug.

 

 

 

Extended Expiration Date of Legal Use of CBD Solution

 

Effective July 1, 2021, the expiration date of the Harper Grace's Law (Law) is extended for three years to July 1, 2024 (from July 1, 2021).  The Law permits the possession and use of cannabidiol (CBD solution) for medical purposes by individuals with a debilitating epileptic condition or related illness.

 

 

Mississippi Medical Marijuana

Mississippi voters overwhelmingly approved the legalization of medical marijuana in the Magnolia State. They approved Initiative 65 to amend the state constitution to allow qualified patients with debilitating medical conditions, as approved by a physician, to use medical marijuana, provided it is obtained from a licensed treatment center.

 

The Mississippi State Department of Health will regulate and enforce the provisions of this amendment.
