DOL Online Tool to Determine FFCRA Eligibility
The DOL released an online interactive tool to assist employees with determining whether they are eligible for leave under the Families First Coronavirus Response Act (FFCRA). Employees can use the tool to determine if their employer is subject to the FFCRA, and if so, whether their situation is a qualifying event entitling them to paid sick leave and/or extended family and medical leave. The DOL's website states an employer tool will be coming soon.
DOL Provides Guidance on Tracking Teleworker Time
On August 24th, the U.S. Department of Labor (DOL) issued guidance on tracking teleworkers’ compensable hours. Employers have always been required to pay workers for all time “suffered or permitted to work”. If an employer knows or has reason to believe that work is being performed, the time must be counted as hours worked. Employers are not required to double check every hour through IT records but they must exercise reasonable diligence.

Form I-9 Flexibility Extended
Due to the continued precautions related to COVID-19, the Department of Homeland Security (DHS) has decided to again extend Form I-9 flexibility. The expiration date for this flexibility is now September 19, 2020. This flexibility only applies to employers and workplaces that are operating remotely.
Form I-797, Notice of Action, May Be Used for Form I-9
Employers can accept the Notice of Action (Form I-797) for List C on the Form I-9. The Notice of Action must be dated from December 1, 2019 - August 20, 2020 to be valid and for new employment the employee must provide a document from List B as well. This exception expires on December 1, 2020.
By December 1, 2020, employers must reverify employees who presented this Form I-797, Notice of Action, as a List C document. These employees will need to present their employers with new evidence of employment authorization from either List A or List C.
